Social Network Terms of Use "Tanguear"

1. Definitions

• Service: The online platform "Tanguear" provided for users to share personal data, preferences, reviews, and to access event dissemination services.
• User: Any individual or legal entity that registers, accesses, or uses the Service.
• Account: A registered user profile used to access the Service.
• Personal Data: Any information that identifies or can be used to identify a User, including but not limited to name, email address, contact details, and profile information.
• Preferences: Information provided by Users regarding their interests, tastes, and choices within the world of tango.
• Reviews: User-generated evaluations, opinions, or ratings concerning tango-related events, venues, or experiences.
• Geolocation Data: Data regarding the physical location of the User, collected through device location services for the purpose of providing localized event information.
• Content: Any information, data, text, images, reviews, and other materials uploaded or published by the User on the Service.

2. Acceptance of the Terms

• By accessing and using the Service, the User acknowledges that they have read, understood, and agree to be bound by these Terms of Use.
• If the User does not agree to these Terms, they must refrain from using the Service immediately.

3. User Registration and Account Responsibilities

• Registration may be required to access certain features of the Service. The User agrees to provide accurate, complete, and up-to-date information during the registration process.
• The User is solely responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their Account.

• For technical reasons and to offer localized event dissemination, the Service collects Geolocation Data from Users.
• Geolocation Data is used to:
  • Provide Users with information about nearby tango-related events.
  • Enhance the accuracy and relevance of event recommendations.
• The User consents to the collection and use of Geolocation Data in accordance with these Terms and the Privacy Policy.
• Users may disable geolocation services through their device settings; however, doing so might limit the functionality of the Service.

6. Intellectual Property Rights

• The Service and all related materials, software, and design are protected by intellectual property laws and are owned by Tanguear or its licensors.
• Users retain ownership of their published Content but grant Tanguear a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such Content for the purposes of operating and promoting the Service.
• Any unauthorized use of the Service's intellectual property is strictly prohibited.

7. User Content and Reviews

• Users are solely responsible for the Content they publish, including reviews, opinions, and preferences.
• By posting Content, the User represents and warrants that:
  • They hold all necessary rights and permissions to publish the Content.
  • The Content does not violate any third-party rights or applicable laws.
• The Service reserves the right to remove or modify any Content that it deems inappropriate, unlawful, or in breach of these Terms.

8. User Conduct and Obligations

• Users agree to use the Service in a manner that is lawful, respectful, and consistent with these Terms.
• The following actions are strictly prohibited:

9. Disclaimer of Liability and Limitation of Liability

• Tanguear does not guarantee the accuracy, completeness, or timeliness of any Content, including event information and reviews.
• To the maximum extent permitted by applicable law, Tanguear shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
  • The use or inability to use the Service.
  • The reliance on any Content or information provided on the Service.
  • Unauthorized access to or alteration of Personal Data or Geolocation Data.
• The User acknowledges that participation in events and reliance on the published Content is at their own risk.

10. Modifications and Updates

• Tanguear reserves the right to modify or update these Terms at any time, with or without notice.
• Continued use of the Service following any modifications constitutes acceptance of the updated Terms.
• Significant changes to the Terms will be communicated to Users via the Service or through registered contact details.

11. Dispute Resolution and Governing Law

• These Terms shall be governed by and construed in accordance with Italian law.
• Any disputes arising from or relating to these Terms or the use of the Service shall be resolved through amicable negotiations.
• Failing an amicable resolution, disputes shall be submitted to the exclusive jurisdiction of the courts in Trieste, Italy.

12. Miscellaneous

• Entire Agreement: These Terms, along with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between the User and Tanguear.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• No Waiver: Failure by Tanguear to enforce any provision of these Terms does not constitute a waiver of such provision.
• Assignment: Tanguear may assign its rights and obligations under these Terms to any third party without prior notice to the User.
• Force Majeure: Tanguear shall not be liable for any failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, government actions, or other events beyond its control.

13. Safety Standards, Abuse Reporting, and Compliance with Google Play Policies

Tanguear is dedicated to providing a safe and respectful environment for all Users and ensures compliance with Google Play’s safety standards for social applications.

13.1 Eligibility and Age Declaration

• The Service is intended exclusively for individuals aged 18 or older.
• Tanguear does not collect or verify the User’s age during registration.
• By creating an Account, the User self-declares to meet the minimum age requirement and agrees not to permit minors to use the Service through their Account.

13.2 Abuse Reporting and Moderation Tools

Tanguear offers several tools for Users to report inappropriate or harmful behavior across the platform, including:

• Event listings
• Organizer profiles
• User profiles
• Internal messaging/chat
• Reviews and comments

Users may flag any content or behavior that is illegal, abusive, harassing, misleading, discriminatory, sexually inappropriate, or otherwise unsafe.

Tanguear is committed to:

• Reviewing all abuse reports promptly
• Taking appropriate actions such as warning, restricting, or removing content, or suspending Accounts that violate these Terms
• Giving priority to reports concerning physical safety, harassment, or other high-risk issues

13.3 Automated Safety Systems (Google Perspective API)

• To help maintain User safety and respectful interactions, Tanguear uses the Google Perspective API and similar automated systems to detect toxic, harmful, or inappropriate content.
• These tools assist in flagging messages, comments, and other text-based interactions for moderation, but do not replace human judgment.
• Users acknowledge that automated systems may occasionally misclassify content and agree to adhere to these Terms when using the Service.

13.4 Prohibited Conduct

The following actions are strictly prohibited:

• Harassment, bullying, threats, or hate speech
• Uploading or sharing sexually explicit content or any content involving minors
• Attempting to exploit, solicit, or endanger other Users
• Using the Service to misrepresent identity or impersonate others
• Trying to bypass safety systems or automated moderation

Tanguear reserves the right to take decisive action against any behavior that endangers the safety of Users.

14. Community Hosting

Tanguear may allow users to offer or request temporary accommodation in connection with specific events published on the platform.

This feature is designed solely to facilitate connections between members of the tango community who may wish to offer or request hospitality.

Tanguear does not own, manage, provide, inspect, or control any accommodation offered through the platform.

14.1 Nature of the Service

• Tanguear acts exclusively as a technical platform that enables users to connect.
• Any hosting arrangement is a private agreement between the host and the guest.
• Tanguear is not a party to any agreement between users and does not participate in or supervise the hosting relationship.

14.2 No Guarantees

Tanguear does not guarantee:

• the availability of accommodation
• the safety, suitability, or condition of any property
• the identity or conduct of any user
• the accuracy of information provided by hosts or guests

Users are solely responsible for evaluating whether to offer or accept accommodation.

14.3 User Responsibility

Hosts and guests are fully responsible for:

• their own conduct
• the safety of the accommodation offered
• compliance with applicable local laws and regulations
• any agreements made between them

Users agree that any hosting arrangement is entered entirely at their own risk.

14.4 Limitation of Liability

To the fullest extent permitted by applicable law, Tanguear shall not be liable for:

• any damages, injuries, losses, or disputes arising from hosting arrangements between users
• any acts or omissions of hosts or guests
• any conditions or circumstances related to accommodations offered through the platform

14.5 Platform Role

Tanguear's role is limited to:

• allowing users to publish hosting offers
• displaying such offers in connection with events
• facilitating contact between users

Tanguear does not verify the safety, legality, or suitability of any hosting offer.

14.6 Safety Notice

Users are encouraged to take appropriate precautions when interacting with other members of the community, including:

• communicating clearly before meeting
• verifying relevant information
• making their own assessment of safety and trust.
